RULES FOR SUSPENDING AND RESUMING ECONOMIC ACTIVITY

Economic activity may be suspended by an entrepreneur who does not employ workers.

An entrepreneur who does not employ workers is an entrepreneur who has not entered into employment relationship with workers within the meaning of the Labour Code. Persons who suspend economic activity do not cease to be entrepreneurs.

Economic activity is suspended and resumed upon the entrepreneur’s application.

The form of application for entry into CEIDG is also the form of application for suspending or resuming economic activity.

The application for suspending or resuming economic activity may be filed:

1. on line – if your entry has already been transferred into CEIDG – using electronic signature, verified on the basis of qualified certificate, signature confirmed by means of entrusted profile in ePUAP, or personal signature referred to in legal provisions on personal identity cards, or using any other manner accepted by CEIDG that allows for definite identification of the person submitting the application and the time of submitting it.

2. in gmina office – in person or by registered mail (an application sent by registered mail should bear the handwritten signature of the applicant certified by a notary public).

Should the application for entry into CEIDG be incorrect:

1. if the application was submitted on line – CEIDG will immediately notify of the incorrect data in the application;
2. if the application was submitted in the gmina office – the body will immediately call for amending or supplementing the application within 7 working days.

The entrepreneur can suspend economic activity for a period ranging from 30 days to 24 months. If the entrepreneur does not resume activity within 24 months, the entry will be deleted ex officio.

The entrepreneur conducting economic activity as a partner in more than one private partnership can suspend his/her conducting of economic activity in one or several of such partnerships.

The entrepreneur conducting economic activity in various legal forms can suspend his/her economic activity in one of those forms.

The suspension period can be expressed in days, months or months and days. The suspension period starts on the day indicated in the application, but not earlier than on the day of submitting the application, and runs until the day of submitting the application for entry of the information on resuming economic activity or to the day indicated in the application, which may not, however, precede the day of submitting the application.

Within the suspension period, the entrepreneur cannot conduct economic activity and generate current revenue from non farming economic activity.


Within the suspension period, the entrepreneur:

1. has the right to perform all activities necessary to maintain or secure the source of income;

2. has the right to collect receivables or the obligation to cover liabilities that had arisen before suspending economic activity;

3. has the right to dispose of his/her own fixed assets and equipment;

4. has the right or obligation to participate in legal, tax and administrative proceedings connected with economic activity pursued before the suspension;

5. fulfils all obligations imposed in legal provisions;

6. has the rights to earn revenue, including from the activity pursued before the suspension;

7. can be subject to control according to the rules applicable to entrepreneurs conducting economic activity.
